TERMS OF SALE
These conditions of sale regulate the purchase of Products offered by Grupo BC to its customers through the Website. Grupo BC operates through the Website, exclusively, for the Spanish territory comprised of the Iberian Peninsula and the Balearic Islands.
The descriptions of the Products offered on the Website are made based on information from our Quality and Production department.
The photographs and graphic representations related to the Products, as well as trade names, trademarks or distinctive signs of any kind contained on the Website are intended to provide the Client with as much information as possible. In the event that, due to circumstances of force majeure or due to an incident attributable to Grupo BC, the Product is not available after the purchase has been made, Grupo BC will contact the Client to reimburse the corresponding amount.
PRODUCT PRICES AND SHIPPING COSTS
The prices of the Products offered through the Website include VAT. However, these prices do not include the shipping costs of the Products. Unless another rate is indicated during the purchase process, the shipping costs will be €6.95. These expenses must be accepted by the Customer at the time of the order request.
Grupo BC reserves the right to modify its prices at any time. Products will be charged to the Customer at the advertised price at the time the order is placed.
PURCHASE OF PRODUCTS AND PLACEMENT OF ORDERS
Grupo BC will send, within twenty-four (24) hours, an email acknowledging receipt and confirmation of the purchase made. The purchase of the Product will be understood as perfected at the moment of receipt of the payment of the price by Grupo BC.
PAYMENT OF THE PRODUCTS
The Client must make the payment by credit or debit card Visa, MasterCard, American Express, Visa Electron and/or other similar cards, or through the PayPal system.
The card with which the payment is made must have as issuing financial institution a Spanish bank or savings bank or a branch or subsidiary financial institution of a foreign financial institution with establishment in Spain.
The Client must notify Grupo BC, via e-mail: email@example.com, of any undue or fraudulent charge on the card used for purchases on the Website, in the shortest possible time, so that Grupo BC can carry out the procedures it deems appropriate.
Once the purchase process is finished, an electronic document is generated in which the contract is formalized and which the Client can print and which is filed in the My Account > Orders section.
CANCELLATION AND EXTENSION OF ORDERS
Customers may cancel or extend orders before receiving the Product as long as the order is in “Confirmed” status, once the status changes to “shipped”, no changes can be made.
Grupo BC will inform the Client, before the end of the purchase process, of the delivery time for the Products, which will normally be 3-7 business days.
Grupo BC does not deliver Products on Saturdays, Sundays, national, regional and local holidays. Grupo BC may inform the Client, by sending an email to their email address, of the date of departure from the warehouses of the corresponding Product order and the contact details of the transport company that is going to make the delivery. Within 72 hours from that date, the Product will be delivered to the address indicated by the Customer, except in circumstances of force majeure. The delivery is considered made from the moment in which the Product has been made available at the place of delivery indicated by the Customer. The risk of the Products (among others, loss, damage or theft) will be transferred to the Client from the moment they have been made available to him at the place of delivery.
Place and conditions of delivery
Grupo BC undertakes to deliver the Product in perfect condition to the address indicated by the Client, which, in any case, must be within the Territory. In order to optimize the delivery process, the address provided by the Customer must be an address to which delivery can be made within normal business hours. If at the time of delivery of the Product to the address indicated by the Customer, there is nobody, the Customer must then contact the carrier as soon as possible to arrange a delivery date. Grupo BC guarantees the delivery of the Product during the ten (10) calendar days following the date of the email sent by Grupo BC informing the Client that their order is on its way. If the delivery of the Product to the Client has not been made within the period of 10 days indicated for reasons not attributable to Grupo BC or the carrier, the Products will be returned to our warehouses and the Client will be responsible for the shipping and return costs. .
The delivery address will be the one indicated by the Client when making the purchase. In the event that the Customer, after making the purchase, would like to modify the delivery address, they may do so as long as the order is in “Confirmed” status. At the time of delivery of the Product, the Client or the recipient must show an identification document to the carrier, verify the apparent condition of the packages and sign and note on the delivery note (in the format presented by the carrier) the observations and apparent reservations at the time (for example, due to missing packages or apparent damage or tampering to the Products or packaging). In the event that, when opening the packages with the Products, the Client sees that they are damaged due to transport, that they are wrong or that Products are missing from the same order, they must notify Grupo BC in writing within a period of 5 calendar days from delivery.
RETURN OF PRODUCTS
The Client will have a maximum period of fourteen (14) calendar days from the delivery of the Product, to communicate their total or partial withdrawal from the purchase of the Product, in accordance with the applicable legislation. Once the period of fourteen (14) calendar days has expired, Grupo BC will not accept returns for withdrawal of purchases of Products. The return made within the term will not entail any penalty, however, the Client must bear the shipping costs of the return.
The Product must be in the same condition in which it was received, with the original labeling. The Client must send the Product in the same box or bag or in some similar format. In the event that the Product is not sent with the original packaging, the Product may suffer a depreciation. The purchase receipt for the Products must always be included in the package.
Reembolso del precio:
El Cliente tendrá derecho al reembolso del precio de los Productos devueltos, siempre que los Productos devueltos se hallen en las mismas condiciones en que fueron entregados, no hayan sido usados (salvo lo necesario para verificar su adecuación con lo esperado), lavados, dañados, desprecintados (en los casos previamente indicados), o extraviados antes de llegar a las dependencias de Grupo BC o no se hayan cumplido los requisitos establecidos en estas Condiciones de Venta. Grupo BC comprobará en su almacén la adecuación del Producto devuelto, reservándose el derecho a no realizar el rembolso en caso de detectar que el Producto adquirido y el devuelto no coinciden o que la devolución no se ha realizado conforme a las presentes Condiciones de Venta.
Grupo BC gestionará la orden de devolución del precio y gastos de envío (si los hubiese) mediante el mismo sistema de pago utilizado por el Cliente para la adquisición de los Productos, en un plazo no superior al transcurso de 14 días naturales desde que el Cliente comunicó su desistimiento. La aplicación de la devolución del precio y gastos de envío en la cuenta o tarjeta del Cliente dependerá de la tarjeta y de la entidad emisora. El plazo de aplicación de la devolución del precio será de hasta siete (7) días naturales para las tarjetas de débito y de hasta treinta (30) días naturales para las tarjetas de crédito.
Devolución de Productos defectuosos:
El Cliente tendrá derecho al reembolso del precio de los Productos defectuosos o de los Productos entregados si no se corresponden con el pedido realizado por el Cliente, de conformidad con la legislación aplicable. En el caso de devolución de Productos defectuosos, o que no se corresponden con el pedido realizado por el Cliente, Grupo BC se hará cargo de los costes de transporte de la devolución de los Productos, siempre y cuando la devolución se realice desde dentro del Territorio.
The Client will have the right to reimbursement of the price of the returned Products, provided that the returned Products are in the same conditions in which they were delivered, have not been used (except as necessary to verify their suitability with what was expected), washed, damaged, unsealed (in the cases previously indicated), or lost before arriving at the BC Group premises or the requirements established in these Conditions of Sale have not been met. Grupo BC will check the adequacy of the returned Product in its warehouse, reserving the right not to make the refund if it detects that the Product purchased and the returned Product do not match or that the return has not been made in accordance with these Conditions of Sale.
Grupo BC will manage the order to return the price and shipping costs (if any) through the same payment system used by the Client for the acquisition of the Products, within a period not exceeding 14 calendar days from the time the Client communicated his resignation. The application of the refund of the price and shipping costs in the Customer’s account or card will depend on the card and the issuing entity. The period for applying the price refund will be up to seven (7) calendar days for debit cards and up to thirty (30) calendar days for credit cards.
Return of defective Products:
The Customer shall be entitled to reimbursement of the price of the defective Products or of the Products delivered if they do not correspond to the order placed by the Customer, in accordance with the applicable legislation. In the case of returning defective Products, or that do not correspond to the order made by the Client, Grupo BC will bear the transportation costs of returning the Products, as long as the return is made from within the Territory.
